WINDSOR UPDATE: THE IMPACT OF THE FALL OF DOMA ON BROKERS AND EMPLOYERS

Todd Solomon, Partner, Employee Benefits Practice Group, MCDERMOTT WILL & EMERY LLP

When the Supreme Court struck down the Defense of Marriage Act last summer, and the Internal Revenue Service followed with Revenue Ruling 2013-17, employers were put on notice that they must accommodate same-sex marriage in many areas of benefits. This session will cover how the repeal of DOMA affects benefits, and offer brokers the knowledge they need to be fluent on the topic.

Topics to cover are:

-Impact on federal tax withholdings

-Affect on after-tax premium payment withholdings

-Possible refunds to employers on FICA tax withholdings

-Affect on retirement plan benefits

-Impact on death benefit protections
