THE ROAD TO A LAWSUIT IS PAVED WITH GOOD INTENTIONS: AVOIDING LEGAL TROUBLE WITH WELLNESS PROGRAMS

Federal regulators promote wellness programs - especially with regard to tobacco use and obesity - but they also adamantly oppose discrimination on the basis of medical and health conditions. What's an employer to do? In this presentation, Roger Abramson, general counsel at Ameriflex will provide an overview of the latest rules pertaining to wellness programs (as codified by the 2010 ACA) and explain how these rules may conflict with the Genetic Information Nondiscrimination Act (GINA), the Americans with Disabilities Act (ADA), and other rules and laws enforced by the Equal Employment Opportunity Commission (EEOC). Benefits executives and advisers will become equipped to navigate these unsettled regulatory waters as they seek to increase workforce wellness and reduce healthcare costs without crossing discriminatory boundaries. Real-life case studies will be considered and specific ideas for program implementation - both conservative and aggressive - will be offered to attendees. The program will conclude with a hands-on design-your-own wellness program module.
